Terms of Use

The phonodia.com website and the online store on it are provided by the Center for Vocal Arts of Crete (NPO), based at 3 Ierolochiton Street, 71305, Heraklion, Crete. This store offers clothing and accessories (merch) for sale, as well as digital content (e.g., music in digital format). The goods are produced on demand (print-on-demand) by Needleworks (https://needleworks.gr/), to which the order details are automatically sent for printing and delivery to the customer. Sales are aimed at customers worldwide. By using the online store, each user/customer unconditionally accepts the following terms and conditions. These terms and conditions cover exclusively purchases made through the website, and any other terms or agreements are expressly excluded.

Terms and Conditions of Transactions

• Identity and Legal Framework: The company “Center for Vocal Arts of Crete AMKE” is a non-profit organization, registered under tax identification number EL996445420. All transactions are subject to Greek and European provisions on electronic commerce and consumer protection, such as Presidential Decree 131/2003 (Directive on electronic commerce), Law 2251/1994 on consumer protection (as applicable) and Law 4624/2019 (implementation of Regulation (EU) 2016/679 on personal data). The company fully complies with the provisions of the Civil Code and Law 2251/1994 as applicable.
• Product and Price Information: Each product page lists the basic technical specifications, price (including VAT), and indicative availability. However, any typographical or technical errors in the information on the website are not binding on the company. The company reserves the right to change prices and offers without notice, but undertakes to inform the customer immediately if an order has already been placed in such a case.
• Product Availability: The company makes every effort to provide information on the current availability of products. If a product is out of stock after an order has been placed, the customer will be notified immediately and the order amount will be refunded or canceled without further charge.
• Purchase Agreement: Placing an order through the website is equivalent to an unconditional offer to purchase the listed products. The agreement is considered to have been concluded when the company confirms receipt of the order by email or other electronic message. From that moment on, both parties are bound.
• Payment Methods: Electronic payments by credit/debit card and through systems such as PayPal are accepted, in accordance with the relevant security protocols (SSL). Payment details are handled by third-party providers (banks, credit networks), which adhere to strict security measures.
• Delivery and Shipping: Products are manufactured to order; once the transaction is complete, the company automatically sends the order to Needleworks, which prints the product and ships it directly to the customer. Delivery time is expected within 7–14 business days (at least) from the date of order completion, depending on the item and destination. Shipments are made worldwide. The final shipping cost is borne by the customer, unless otherwise stated in an offer or discount.
• Right of Withdrawal (Returns): The consumer has the right to withdraw from the contract without justification within 14 calendar days of receiving the products. To exercise this right, the customer must notify the company in writing (by email or postal notification), stating their decision to withdraw, before the relevant deadline expires. The company will refund the consumer (including cash on delivery or delivery costs) no later than 14 days after being notified of the withdrawal.
• Exceptions: According to the law, the right of withdrawal does not apply to certain categories of goods. In particular, products that are made to order and personalized by the customer (e.g., clothing or accessories with a special design, color, or size, printed to order) are expressly excluded from the 14-day right of return. (In practice, this means that customers cannot return specially printed products if they change their mind, unless they are defective or incorrect.)
• Returns of Defective Products: If the products are defective or do not match the order specifications, the customer is entitled to a replacement or refund/credit. The customer must report any defect within 2 months of delivery. For returns, a consultation process with the company is followed; products must be sent back to the company in their original condition, at the expense of the manufacturer of the defects.
• Product Warranty: All products are covered by the seller’s statutory liability for defects (Civil Code No. 534 et seq.). If a defect is found within 2 years (for a new product), the consumer may request repair or replacement of the product free of charge. Alternatively, they may request a price reduction or termination of the contract if the defect renders the product unfit for use. For used goods, the warranty period is 1 year.
• Use of the Website: Access to and use of the site is permitted only for lawful purposes in accordance with the law and good morals. It is prohibited to subsequently modify the order data on the part of the user or to misuse the content and services of the website. Each user is required to fill in their personal details correctly when completing forms and orders. The company is not responsible for any inaccurate information provided by the customer.
• Intellectual Property: All texts, images, graphics, logos, trademarks, and other content on the website belong to the company or its partners and are protected by copyright law. Copying, reproduction, or use of these without written permission is prohibited.
• Limitation of Liability: The company is not responsible for any interruptions in the operation of the website, technical problems in data transmission networks, or other force majeure factors that prevent the use of the platform. It also disclaims any liability for damages resulting from illegal acts of third parties (e.g., data theft, cyber attacks) or user negligence. The information and services are provided “as is” without any warranty of fitness for a particular purpose beyond those expressly agreed upon.
• Modification of Terms: The company reserves the right to unilaterally modify these terms and conditions at any time. Any changes will be posted on the site and will apply to new orders. Users are advised to check the terms regularly before making purchases.
• Applicable Law – Jurisdiction: Any dispute that may arise between the consumer and the company shall be governed exclusively by the provisions of Greek law and, where applicable, European law. Legal disputes shall fall under the jurisdiction of the Greek courts.
